TERMS OF SERVICE

These Terms of Service apply to the use of tryink.nl and purchases made from TryInk.

By placing an order, you confirm that you have read and accepted these Terms of Service together with our Return and Refund Policy, Shipping Policy and Privacy Policy.

Nothing in these terms limits any mandatory rights available to consumers under Dutch or applicable European Union law.

1. WHO MAY PLACE AN ORDER

You must be legally capable of entering into a purchase agreement.

If you are under 18, you may only place an order with permission from a parent or legal guardian. By placing an order, you confirm that you have the required permission.

Products must not be purchased or used in a way that is unlawful or inconsistent with the supplied application and safety instructions.

1. TRYINK PRODUCTS

TryInk sells temporary, skin-developed tattoos.

The design normally develops gradually after application and may take up to 24 hours to reach its developed appearance. Wear time can be up to approximately two weeks, but the exact colour, development time and duration vary between individuals.

Results may be affected by:

• skin type and skin preparation;
• application technique;
• placement on the body;
• exposure to water, friction, skincare products and perspiration; and
• natural skin renewal.

Product photographs and before-and-after examples illustrate typical results but cannot guarantee an identical result for every customer. Screen settings may also affect how colours and proportions appear online.

The dimensions stated on the product page describe the approximate physical dimensions of the supplied tattoo or design. Minor production tolerances may occur.

1. SAFE AND APPROPRIATE USE

Read and follow the current application, ingredient and safety information supplied with the product and displayed on the TryInk website.

Do not use a product if its individual packaging was already open or damaged when delivered. Contact shop@tryink.nl instead.

TryInk tattoos are not intended for use on the face, lips, eyes, neck, upper chest, intimate areas, irritated or damaged skin, areas with excess hair, or directly over scars, moles or stretch marks.

Do not use a product if you know that you are allergic or sensitive to one of its stated ingredients.

Stop using the product if irritation or another unexpected reaction occurs. Remove or rinse the product as directed and seek appropriate medical advice if symptoms are serious or persistent.

TryInk products are cosmetic products and are not intended to diagnose, treat, cure or prevent a medical condition.

Use by children should be supervised by a responsible adult.

1. PRICES

Prices are displayed in euros.

The price shown during checkout is the price payable for the order, including applicable taxes. Delivery charges are shown separately before the order is submitted.

We may change prices for future purchases at any time. A price change does not affect an order that has already been accepted.

If a product or price is displayed incorrectly because of an obvious technical or administrative error, we will contact you promptly. You may confirm the order at the correct price or cancel it for a full refund. We will not charge a different price without your agreement.

1. ORDERS AND FORMATION OF THE AGREEMENT

Before submitting an order, you can review and correct the products, quantities, delivery address and total price shown during checkout.

By selecting the final payment or order button, you submit an offer to purchase the products in your cart and accept the obligation to pay the displayed total.

A purchase agreement is concluded when TryInk sends an order confirmation accepting the order to the email address provided during checkout.

Please check the order confirmation and contact shop@tryink.nl promptly if any information appears incorrect.

Receiving payment does not require us to fulfil an order where:

• the product is unexpectedly unavailable;
• the payment cannot be verified or is reversed;
• the order contains an obvious pricing or technical error;
• we reasonably suspect fraud, misuse or unlawful activity; or
• fulfilment would violate a legal requirement.

If we cannot accept or fulfil an order, we will notify you and refund the amount paid for the affected products and delivery without undue delay.

1. PAYMENT

Available payment methods are displayed during checkout and may be processed by Shopify or another authorised payment provider.

You confirm that you are authorised to use the selected payment method and that the billing information provided is accurate.

TryInk does not receive or store complete payment-card details when payment is processed by an independent payment provider.

1. BUNDLE DISCOUNTS AND PROMOTIONS

Where displayed on the website, eligible bundle discounts include:

• 20% off when purchasing 3 eligible tattoos; and
• 30% off when purchasing 5 eligible tattoos.

The cart and checkout will show the discount that applies to the selected eligible products. The conditions displayed with a promotion at the time of purchase form part of that promotion.

Unless expressly stated otherwise:

• discounts apply only to eligible products purchased in the same order;
• discounts cannot be exchanged for cash;
• discount codes and promotions cannot be combined; and
• a promotion cannot be applied retrospectively to a completed order.

If part of a discounted order is validly returned, the refund for each returned product is based on the discounted amount actually paid for that product, as recorded in the order confirmation.

TryInk may change or end a promotion for future orders. This does not affect an order that has already been accepted.

1. GIFT CARDS

If TryInk offers gift cards, any specific gift-card conditions displayed at the time of purchase apply in addition to these terms.

Gift cards cannot be exchanged for cash except where required by law. Nothing in this section limits statutory withdrawal or consumer rights that apply to a gift-card purchase.

1. DELIVERY

TryInk currently delivers to the Netherlands and other European Union destinations available during checkout.

Current delivery costs, processing times, estimated delivery times, delivery restrictions and procedures for delayed or missing orders are described in our Shipping Policy.

Delivery estimates are not guaranteed arrival dates unless TryInk has expressly confirmed a specific date in writing.

The risk of loss or damage remains with TryInk until you, or a person designated by you other than the carrier, physically receives the order, except where you independently appoint a carrier that was not offered by TryInk.

1. CANCELLATIONS, RETURNS AND REFUNDS

Consumers generally have a 14-day statutory right of withdrawal for eligible online purchases.

The conditions, procedure, return address, hygiene-seal exception, personalised-product exception and refund arrangements are explained in our Return and Refund Policy.

Every tattoo is individually hygiene-sealed. Breaking the seal of one individual tattoo does not affect the return eligibility of other sealed tattoos from the same order.

Your statutory rights concerning damaged, defective, unsafe or incorrect products are not restricted by the hygiene-seal provisions.

1. PRODUCT CONFORMITY AND STATUTORY GUARANTEE

TryInk is responsible for supplying products that conform to the purchase agreement.

If a product is damaged, defective, unsafe or different from what you ordered, contact shop@tryink.nl as soon as reasonably possible.

Depending on the circumstances and your statutory rights, an appropriate solution may include replacement, a price reduction or a refund. TryInk will cover reasonable return costs where a return is required because the product does not conform to the agreement.

Any commercial statement or voluntary assistance offered by TryInk is additional to, and does not replace, the statutory guarantee.

1. WEBSITE AVAILABILITY AND ACCURACY

We try to keep product descriptions, availability, prices and website information accurate and current.

Temporary interruptions, maintenance or technical errors may occasionally affect the website. TryInk does not guarantee that the website will always be available without interruption, but we will take reasonable steps to correct problems within our control.

We may update, remove or change website content and products offered for future purchases.

1. ACCEPTABLE USE

You must not:

• use the website for unlawful or fraudulent activity;
• interfere with the security or operation of the website;
• attempt to gain unauthorised access to accounts, systems or customer information;
• introduce malicious code or automated tools that place an unreasonable load on the website;
• copy or exploit website content for commercial purposes without permission; or
• provide false information or impersonate another person.

We may restrict access where reasonably necessary to protect TryInk, customers or the website from fraud, security threats or unlawful activity.

1. INTELLECTUAL PROPERTY

The TryInk name, logo, website design, product presentation, photographs, illustrations, written content and original tattoo designs are protected by applicable intellectual-property rights.

Purchasing a tattoo gives you the right to use the physical product for its intended personal use. It does not transfer ownership of the underlying design or grant permission to reproduce, manufacture, distribute or commercially exploit it.

You may photograph and share a tattoo you have applied for personal and non-commercial purposes.

1. THIRD-PARTY SERVICES AND LINKS

The website may use or link to services operated by third parties, including payment providers, delivery services and Shopify.

Third-party services may have their own terms and privacy information. TryInk is not responsible for unrelated content or services controlled by an independent third party.

This section does not exclude TryInk’s responsibility for parties used to fulfil our obligations to you, including payment processing and delivery.

1. PRIVACY

Personal data is handled in accordance with the TryInk Privacy Policy.

We use information such as your name, contact details, delivery address and order information where necessary to process orders, deliver products, provide customer service, prevent fraud and meet legal obligations.

Marketing communications are sent only where there is an appropriate legal basis. You can unsubscribe from marketing emails using the link provided in those messages.

1. LIABILITY

TryInk does not exclude or restrict liability where doing so would be unlawful.

Nothing in these terms excludes or limits liability for:

• death or personal injury caused by negligence;
• intentional misconduct or deliberate recklessness;
• liability under mandatory product-safety or product-liability law;
• failure to fulfil mandatory consumer obligations; or
• any other liability that cannot legally be excluded.

TryInk is not responsible for losses that were not reasonably foreseeable when the agreement was concluded or for losses caused by a customer’s use of a product contrary to clear application or safety instructions.

Products purchased for personal use must not be resold or used commercially without prior written agreement. TryInk is not liable for business losses arising from a consumer purchase, except where liability cannot lawfully be excluded.

1. EVENTS OUTSIDE OUR REASONABLE CONTROL

TryInk is not responsible for a delay caused by circumstances outside our reasonable control, such as major postal disruption, natural disasters, government measures, widespread system outages or industrial action.

We will take reasonable steps to reduce the effect of the delay and inform affected customers where appropriate.

This section does not remove your statutory rights if an order is not delivered within the agreed or legally required period.

Include your order number where applicable and explain the issue clearly. We will acknowledge and handle complaints as soon as reasonably possible.

If a complaint cannot be resolved directly, you retain the right to use any competent consumer-dispute procedure or court available under applicable law.

1. GOVERNING LAW

These terms and purchase agreements with TryInk are governed by Dutch law.

If you live in another European Union country, this choice does not remove mandatory consumer protections provided by the law of your country of residence.

Any dispute may be submitted to a court that has jurisdiction under applicable consumer and procedural law. These terms do not require a consumer to bring a claim exclusively before a court in the Netherlands where such a restriction would be unlawful.

1. CHANGES TO THESE TERMS

We may update these terms when reasonably necessary, for example because of legal, operational or website changes.

The version that applied when an order was placed continues to govern that order. Changes will not retroactively reduce rights relating to an existing purchase.

1. SEVERABILITY

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue to apply. The affected provision will apply only to the extent permitted by law.
